Sublet Rental Agreement

Tenants who rent for less than two (2) years (or on a monthly or weekly basis) must obtain written permission from their landlord prior to subletting. It can be considered that tenants bound by a rental contract of two (2) years or more can actually sublet without the authorization of the lessor (unless specified in the rental agreement). A sublet is a document that allows a tenant to rent their place to another person known as a “tenant.” This requires the agreement of the lessor, as subletting is prohibited in the rental agreement between the tenant and the lessor (“master lease agreement”). A sublease must not go beyond the end date of the master lease unless it has been approved by the lessor. According to the official state gazette, tenants can introduce a subtenant into their property as long as the lease does not prohibit it. Although not specified, it is nevertheless recommended that tenants obtain permission from their landlord prior to subletting. Before signing the sublease, the tenant and subtenant must conduct a tour of the tenancy. All damages, defects or faulty systems must be listed. The first step a tenant should take in the sublease process is to review the lease signed with the lessor.

In most cases, there will be a full section dedicated to subletting. Enter the full address where the rental is located. Write down the number of roommates the sub-receiver will have. If they rent all the land alone, write the number “1”. If the tenant shares a rented room, activate the first check box and write the names of the other tenants who share the room. If the sub-receiver does not share a bedroom, “N/A” can be written in the name field.
